Pup Social Membership Down Payment Terms & Conditions

Please read the following Pre-Opening Membership Terms & Conditions ("Terms") carefully before securing a membership for your pup with Pup Social Chicago LLC, located at 2200 N Ashland, Chicago IL 60614. By making a down payment, the Owner acknowledges and agrees to the following terms on behalf of their pup ("Pup Member"):

Acknowledgement

• By making the Down Payment, the Owner acknowledges that they have read and understood these Terms and agrees to be bound by them on behalf of their Pup Member. The Owner also acknowledges that they meet the age requirement and that their Pup Member meets the health and age requirements as stated above. Furthermore, the Owner acknowledges that this is a limited disclosure for the presale and does not constitute the complete membership agreement, which will be required to be executed on the date of membership activation.

1. Membership Down Payment

• Amount: A down payment of $350.00 ("Down Payment") is required to secure a membership for the Pup Member at Pup Social.

• Purpose: This Down Payment serves as a guaranteed security for the limited number of membership plans that will be offered and available once Pup Social opens.

• Application Towards Annual Membership: The Down Payment can be applied towards any annual membership plan on the day of activation within 60 days from the official club opening. If the Down Payment is not used towards membership activation within the 60 days, Pup Social reserves the right to add the Pup Member to the waitlist, and the amount may apply to the current and possibly prevailing rate available to the public on the date of activation.

2. Terms of Activation

• Activation Period: Membership must be activated within 60 days from the official opening date of Pup Social.

• Annual Membership Plan: The Down Payment will be credited towards the annual membership plan chosen on the day of activation.

• Rate Protection: The Down Payment secures the rates advertised on the date of the Down Payment, regardless of any potential rate increases at the time of activation.

3. Membership Requirements

• Age Requirements: On the date of activation, the Owner must be at least 21 years of age, and the Pup Member must be at least 4 months old.

• Vaccination and Neutering/Spaying: The Pup Member must be up to date on all vaccinations, including Rabies, Distemper, Parvovirus, Bordetella, Canine Influenza, and Leptospirosis, and neutered/spayed if they are over 8 months old.

• Health and Wellness: The Pup Member must be free of any contagious diseases and in good health as verified by a licensed veterinarian.

• Behavioral Test: All Pup Members seeking memberships will be subject to a behavioral test on the date of membership activation.

4. New Membership Agreement

• Execution of Agreement: Pup Social reserves the right to require the execution of a new and complete membership agreement on the date of membership activation.

5. Restricted Breeds

• Breed Restrictions: Pup Social reserves the right to restrict a limited list of breeds at its discretion.

• Refund Policy: The Down Payment is non-refundable and cannot be applied towards month-to-month plans or daily passes. Should the Pup Member's breed be restricted, the Down Payment will be returned in full to the Owner.

6. Governing Law

• Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of the State of Illinois.

7. Waiver of Liability

• Social Club Nature: The Owner understands and acknowledges that Pup Social is a social canine club and not a boarding or daycare facility.

• Liability Waiver: The Owner agrees that Pup Social shall not be held liable for any damage, injury, or loss resulting from the Pup Member's participation in club activities.

8. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between the parties and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter hereof.

• Amendments: No amendment or modification of these Terms shall be effective unless in writing and signed by both parties.

• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.

• Waiver: The waiver by either party of any breach of these Terms shall not operate or be construed as a waiver of any subsequent breach.

9. Additional Provisions

• Emergency Care: In the event of an emergency, Pup Social will make every effort to contact the Owner. If the Owner cannot be reached, Pup Social is authorized to seek veterinary care for the Pup Member at the Owner's expense.

• Personal Belongings: Pup Social is not responsible for any loss or damage to personal belongings brought into the club by the Owner or the Pup Member.

• Photographs and Media: Pup Social reserves the right to take photographs and videos of the Pup Member for promotional and marketing purposes. The Owner consents to the use of these images and videos without compensation.
